THE SYSTEM WORKED – THE OUTCOME OF THE LANNY CASE

Rancho Cucamonga, CA – I was right about not having a slow news day yet. Here is the latest follow-up concerning the events that led to Marty Victor’s arrest last Friday, again presented in Lanny Swerdlow’s own words. And now heeerrreeee’s Lanny:
Today a jury found me innocent of all battery charges and that they could not conclude beyond a reasonable doubt whether I had pushed anti-harm reduction activist Paul Chabot at a prohibition promotion seminar sponsored by the Inland Valley Drug Free Community Coalition (IVDFCC). Although the verdict was expected, it did not come easily. This morning when Victor and I got into our car to drive to Rancho Cucamonga for jury deliberations and the resulting verdict, I was depressed beyond belief. The preceding day was not good. A witness that we had believed would be beneficial to our case was not and the closing arguments made by the prosecuting attorney were excellent. I was so impressed with his power point presentation that I would have voted to convict myself. However, I completely underestimated the jury. After the trial was over, the jury foreman informed my attorney that the initial vote was 10 for acquittal and 2 for guilty – the vast majority of the jury never bought into any of the arguments made by the prosecution and saw the victim Paul Chabot as not very believable. There were four people involved in the alleged push – myself and Paul Chabot plus IVDFCC volunteer Mark Bradley and mmj advocate Marty Victor. Everyone placed Paul Chabot in a different place, had a different description on how I got past Paul Chabot and a differing story on how it all went down. There was so much “reasonable doubt” raised that my masterful and cunning attorney, Danielle Butler, drove an 18-wheeler straight through it. It was also apparent that a number of the jurors could not believe that they were spending almost a week of their time deciding a case on whether somebody pushed somebody else. In addition to the absolute stupidity of the case, it is estimated that the police and court costs totaled over $25,000 which will be paid by the taxpayers of San Bernardino County – a county with a $17 million deficit that is resulting in the closure of libraries, reduction of health care programs and other essential county public services. This was so stupid that the judge spent an entire day unsuccessfully trying to convince the DA’s office to drop the case. The SB DA’s office would hear none of it because they were pissed that their mouthpiece to attack medical marijuana, the IVDFCC, had not had a single public meeting since that fateful meeting on Oct. 2, 2007 because they feared having to confront medical marijuana patients in public. They saw me as the instigator and perpetrator of this affront to their authority and with this absurd complaint by Paul Chabot, they felt they had a chance to pull the rug out from under me. Well they failed and instead were shown for the lying, deceitful and vindictive agency that they are. Their prosecution of me dragged on for almost a year with the last two weeks being sheer misery. I lost count of the number of times I had driven from Palm Springs to Rancho Cucamonga. Being under indictment, even for a misdemeanor battery charge, is enormously stressful and frankly, I don’t need any more stress. The charge was false, the arrest was illegal and the prosecution was malicious. I have contacted an attorney and it is our intention to file suit in federal court naming Paul Chabot, the Inland Valley Drug Free Community Coalition, the city of Rancho Cucamonga, the county of San Bernardino and the James Bulte Senior Center as responsible parties for what transpired that evening. As for the IVDFCC, perhaps they will now end their myopic fixation on medical marijuana and turn their attention to the actually serious community health threats posed by drugs such as methamphetamine, heroin, tobacco, alcohol and prescription pharmaceuticals.
